1. Introduction

This campaign allows the participant (“Participant”) to obtain a prize detailed on the following landing page: Don't forget about the OT side of life. (paessler.com) (“Contest”). The Contest details and its conduct are governed by these Terms and Conditions (“T&Cs”).

2. Sponsor

The Contest is organized and sponsored by Paessler AG having its registered offices at Thurn-und-Taxis-Str.14, 90411 Nuremberg, Germany (“the Sponsor”).  

3. Eligibility 

3.1 The Contest is open only to those Participants who sign up at the Contest page and have an active PRTG license with valid maintenance.   
3.2 The Participant declares to have the right and be entitled to participate in the Contest on behalf of the PRTG license owner.  
3.3 Participation in the Contest is free of charge. The participation is void where prohibited by law. 
3.4 Employees of the Sponsor, the sponsoring company/companies, if any, or its affiliates within the meaning of §§15 of the German Stock Corporations Act (“Aktiengesetz”), subsidiaries, advertising or promotions agencies are not eligible, nor are relatives, as defined in § 11 of the German Criminal Code (“StGB”), of these employees. 
3.5 Electronic entries will be deemed made by the authorized account holder of the email address submitted at time of entry. 
3.6 Every winner will be sent one prize only.  
 

4. Timing 

The Contest runs between 19.8.2022 15.10.2022 and winners will be drawn promptly once the contest is ended. Any registration for the Contest received after the closing date will not be considered. 

5. How to Enter 

5.1 The Contest must be entered by submitting an entry using the online form located at the Contest page. The entry must fulfill all requirements, as specified, to be eligible to win a prize. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of the Sponsor.  
5.2 Each Participant may only participate once. Any attempt to circumvent the T&Cs, for example, by participating more than once through the use of multiple email addresses, identities or devices, or any other fraudulent method, will grant the Sponsor the right to exclude the Participant from the Contest at its sole discretion. 
5.3 Any false or fake information provided by the Participant will authorize the Sponsor to exclude him from participation. 
5.4 In the event that the Prize is awarded despite the fact that the winner was not eligible to participate in accordance with section 3 of these T&Cs or due to another legal reason, it shall grant the Sponsor the right to refuse the performance of the prize(s) (defined in number 8 of these Terms). 
 

6.  Data Privacy

The Sponsor is responsible for the collection, processing and use of all personal data of the Participants, as defined by the European General Data Protection Regulation (“GDPR”). The Sponsor processes the data required from the entry fields (first name, last name, e-mail address, company name, and country of residence) for the purpose of carrying out and processing the Contest and notification about and transmission of the prizes. The personal data collected for the competition will be deleted within 30 days after the draw of the winners unless the Sponsor is legally required or entitled to further store the respective information. 

Further data protection provisions including the rights of the Participant under the GDPR, and the contact data of Sponsor’s data protection officer can be found in Sponsor’s privacy statement under

The legal basis for processing is Art. 6 para. 1 lit. b GDPR. 

7. Prizes 

The winners will receive personal guidance on how to use the PRTG monitoring software in its physical infrastructure, e.g., in an industrial environment. 

7.1 Consulting Day (remote):

7.2 PRTG Health Check:  
  • Pre-analysis of the system using Support Bundle/Log files 
  • Remote Call (max 4h) + 1h preparation + 1h follow-up 
  • Follow-Up email with all addressed topics, Health-Check PDF and further recommendations 

7.3 PRTG Health Check:

The prize is as stated, non-transferable and cannot be exchanged.  

All winners will be determined via the Rand function in Excel, i.e., the data of all valid registered participants will be imported into an Excel sheet where they will be assigned a random number and, based on the three smallest random numbers, the names of the three winners will be determined. 

If a Participant that won a prize does not respond after two requests within a period of 3 weeks, the claim to the prize expires. In this case, the Sponsor is entitled to conduct a substitute draw according to the above stated principles and transfer the prize to another Participant. 

8. Terms 

The Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest in the event that a virus, bugs, unauthorized human intervention, fraud, any reason related to legal matters or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Contest. 

In such case, the Sponsor may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by the Sponsor. The Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest or website or violates these T&Cs. 

The Sponsor may modify these T&Cs at any time without notice to Participants by posting revised terms and conditions on the website. Any such changes or modifications shall become effective immediately upon posting. It is the Participant’s responsibility to periodically check for any modifications to these T&Cs. 

9. Use of Company Name and Trademarks   

The Participants grant the Sponsor the right to use their company name, logos, and trademarks solely in connection with the Contest, for example, to identify and describe their participation and the winners, without the need to require prior written consent for individual cases. 

10. Limitation of Liability 

By participating in the Contest Participant agrees to release and hold harmless the Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such Participant’s participation in the Contest and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or internet service; (iv) unauthorized human intervention in any part of the entry process or the Contest; (v) electronic or human error which may occur in the administration of the Contest or the processing of entries. 

11. Agreement to Rules  

11.1 By participating, Participant agrees to be fully and unconditionally bound by these rules and represents and warrants that it meets the eligibility requirements set forth herein.
11.2 In addition, Participant agrees to accept the decisions of the Sponsor, as final and binding as it relates to the Contest. 
 

12. Other provisions 

This contest is not subject to legal recourse. Only the law of the Federal Republic of Germany is applicable, excluding its conflict of laws provisions and the United Nations CISG. 

Should individual provisions of these T&Cs be invalid or unenforceable, this shall not affect the validity of the remaining provisions. In this case, instead of the invalid or unenforceable provisions, such provisions shall be deemed to have been agreed which come as close as possible to the purpose of the invalid or unenforceable provision. The same shall apply in the event of a gap in these T&Cs.
