Rules of the Game

This sweepstakes gives all participants the opportunity to win a prize detailed on the contest page. The details of the prizes and how to enter the sweepstakes are contained in these official rules. The competition is organized and hosted by Paessler AG ("promoter"). Paessler AG is registered in Germany, having its registered offices at Thurn-und-Taxis-Str. 14, 90411 Nuremberg, Germany. By joining the competition, the participant agrees to these terms and conditions.

Eligibility

The contest is open to any person over the age of 18. Void where prohibited by law. Employees of Paessler, or their affiliates or subsidiaries are not eligible, nor are members of these employees' families (defined as parents, children, siblings, spouses, and life partners).

Electronic entries will be deemed as made by the authorized account holder of the email address submitted at time of entry. The "authorized account holder" is deemed to be the natural person who is assigned to a particular email address by the applicable Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. A potential winner may be requested to provide the promoter with proof that the potential winner is the authorized account holder of the email address associated with the winning entry.

Timing

The contest begins on July 14, 2021, and ends at midnight on October 15, 2021. Submissions for the sweepstakes are due no later than 11:59 pm GMT on October 15, 2021.

Use of Data

By participating in the sweepstakes, entrants hereby agree to all uses of their personal information and disclaimers as explained in our Privacy Policy. We will not share your personal data with third parties.

The promoter will present up to six winners of this sweepstakes on its web page. By participating in this sweepstakes, you declare to agree to this form of presentation, and that you own all rights to the material submitted for your entry, including screenshots.

Selection of Winners

The winner will be selected by a jury of at least three Paessler AG monitoring experts from all eligible entries received. The prizes will be awarded via mail and the winners will be notified by the email address provided during entry.

The promoter's decisions as to all matters related to administration of the sweepstakes and selection of winners are final.

The winners will be notified by email within fourteen (14) days after the closing of the sweepstakes. If a potential winner cannot be contacted (no answer within 14 days, e-mail address not reachable, etc.), an alternate entrant will be selected in his or her place from all eligible entries received. The winners must confirm acceptance of his/her prize when contacted within 14 days.

Prize

The winners will be awarded prizes worth approximately 1.500€ in total, ranging from ca. 130€ to 320€ individually, excluding postage and packaging.

The prizes are as stated and are non-transferable and cannot be exchanged. No cash or credit alternatives will be offered. If due to circumstances beyond the promoter's control, the promoter is unable to provide the stated prizes, the promoter reserves the right to award substitute prizes of equal or higher value.

Liability of the promoter

The following exclusions and limitations of liability apply to the promoter's liability for damages, irrespective of any other statutory requirements for claims:

The promoter is liable without limitation to the extent that the damage was caused intentionally or by gross negligence. Furthermore, the promoter shall be liable for breaches of material contractual obligations caused by slight negligence, the breach of which would compromise the achievement of the purpose of the contract, or for breaches of obligations, the fulfillment of which is essential for the proper execution of the competition and on the fulfillment of which the parties regularly rely. However, the scope of liability for the promoter in such a case shall be limited to the foreseeable damage typical for the contract. The promoter is not liable for the slightly negligent violation of other obligations than those mentioned above. The designated limitations of liability shall not apply in the event of injury to life, limb and health, for a defect following the assumption of a guarantee for the quality of a product and in the event of fraudulently concealed defects. Liability under the Product Liability Act shall remain unaffected.

The exclusion or limitation of liability of the promoter also applies to the personal liability of representatives and vicarious agents of the organizer or its employees.

Miscellaneous

Legal recourse is excluded.

The competition shall be governed by the law of the Federal Republic of Germany but excluding application of the United Nations CISG.

Should any of these provisions be or become invalid, the validity of the remaining provisions shall not be affected.
